Digital Millennium Copyright Act Notice

MakeMyColoringBook ("we," "us," or "our") respects the intellectual property rights of others and expects our users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 ("DMCA"), we will respond expeditiously to claims of copyright infringement committed using our service.

Reporting Copyright Infringement

If you believe that your copyrighted work has been copied in a way that constitutes copyright infringement and is accessible via our service, please notify our copyright agent as set forth below.

DMCA Notice Requirements

To file a DMCA notice, please provide the following information:

  1. A physical or electronic signature of the copyright owner or authorized agent
  2. Identification of the copyrighted work claimed to have been infringed
  3. Identification of the material that is claimed to be infringing and information reasonably sufficient to permit us to locate the material
  4. Your contact information, including address, telephone number, and email address
  5. A statement that you have a good faith belief that use of the material is not authorized by the copyright owner, its agent, or the law
  6. A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the copyright owner

Counter-Notification

If you believe that your material was removed or disabled by mistake or misidentification, you may file a counter-notification under Section 512(g) of the DMCA. Counter-notifications must include:

  1. Your physical or electronic signature
  2. Identification of the material and its location before removal
  3. A statement under penalty of perjury that you have a good faith belief that the material was removed by mistake or misidentification
  4. Your name, address, telephone number, and a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or if your address is outside the United States, for any judicial district in which we may be found), and that you will accept service of process from the person who provided the original DMCA notice or an agent of such person

Restoration Process

Upon receipt of a valid counter-notification, we will promptly provide a copy to the original complainant. If the complainant does not file a court action seeking a restraining order against the alleged infringer within 10-14 business days, we will restore or cease disabling access to the material in accordance with Section 512(g)(2)(C) of the DMCA.

Repeat Infringer Policy

We have adopted and implemented a policy that provides for the termination of user accounts of repeat infringers in appropriate circumstances. Our repeat infringer policy operates as follows:

  • First Strike: Warning notice and content removal
  • Second Strike: Temporary account suspension (7 days) and content removal
  • Third Strike: Permanent account termination and all content removal

We maintain records of all DMCA notices and counter-notifications in our database. Strikes are tracked per user account and reset after 12 months of no infringement claims.

Service Level Agreements

Takedown SLA

We remove or disable access to allegedly infringing material expeditiously upon receipt of a valid DMCA notice, typically within 24-48 hours of receipt during business days.

Restoration SLA

Valid counter-notifications are processed within 2-3 business days of receipt. Material is restored or access is re-enabled within 10-14 business days after providing the counter-notification to the original complainant, unless we receive notice that a court action has been filed.

Standard Technical Measures

We accommodate and do not interfere with standard technical measures used by copyright owners to identify or protect copyrighted works. We implement reasonable security measures to protect against unauthorized access to user content and maintain logs for copyright enforcement purposes.

User-Generated Content

Users are responsible for ensuring they have the right to upload and convert any images they submit to our service. By uploading content, users represent and warrant that:

  • They own or have permission to use the uploaded content
  • The content does not infringe on any third-party rights
  • They grant us permission to process the content as described in our Terms of Service
